Joint and several liability
About half the states have recently modified or eliminated their laws on joint and several liability. In these states, if two or more defendants contribute to a tort, then, at least in some circumstances, each is liable only in proportion to his share of responsibility, instead of 100 percent liable.

In 1986, Congress, overturning a Supreme Court decision, authorized courts to award attorney's fees to prevailing plaintiffs in actions or proceedings brought under the Education of the Handicapped Act. This report examines whether retroactive application of the 1986 Act, to the data of the Supreme Court decision, is constitutional.
